Terms of Service

This English version is provided for convenience. In the event of any conflict or inconsistency, the Japanese version prevails.

These Terms of Service (the “Terms”) set out the conditions for using NeedBack (the “Service”), provided by Masashi Ohtsubo, trading as DESIGN PIECE (“we”, “us”, or “our”).

Article 1 (Application)

These Terms apply to all relationships between us and users regarding the use of the Service. By using the Service, you are deemed to have agreed to these Terms.

Article 2 (Fees and billing)

The Service offers a free plan (Free), a paid plan (Pro), and one-time add-on packs. Fees are exclusive of taxes unless the applicable pricing or checkout page states otherwise.

  • Free: ¥0
  • The current price, taxes, and billing unit for paid plans are shown on the pricing and checkout pages.
  • The current price, taxes, and included capacity for add-on packs are shown on the checkout page.

Paid plans are charged to your credit card through Stripe when you subscribe and automatically on each monthly renewal date (or annually for annual plans). You may cancel through the Stripe customer portal at any time, effective on the next renewal date. After cancellation, paid-plan features remain available until the end of the current term. Add-on packs are charged once at purchase and do not renew automatically.

Add-on capacity is used after the monthly allowance is exhausted and remains valid for 12 months from purchase. Unused capacity expires after that period and when an account is deleted. Except where required by law, where we billed you in error or charged you twice, or where we individually approve a refund, fees already paid for paid plans and add-on packs are non-refundable on both monthly and annual plans, including any prorated or unused portion of the term. Cancelling an annual plan partway through its term does not entitle you to a refund for the remaining period.

You may delete your account from the Profile page. Deletion runs 14 days after you request it, on every plan, and you may cancel it at any time before that date. When it runs, any active paid plan is cancelled with no refund for the remaining term. Deleting a shared space works the same way, and on the scheduled date every member of that space loses access to its data.

Article 3 (Data retention)

We retain data that users register in the Service, including projects, review comments, and evidence screenshots, for the periods below according to the applicable plan. Data is deleted in sequence after the relevant retention period.

  • Free: 30 days
  • Pro: 1 year (365 days)

Deleted review comments remain recoverable for the following restoration grace periods.

  • Free: none (deleted immediately)
  • Pro: 30 days

Article 4 (Registration and invitation of third parties)

If a user registers or invites a client or other third party as a registered reviewer, the user is responsible for obtaining consent, giving notice, and taking any other action required by applicable law for us to handle that third party’s email address, display name, and other personal information.

If a registered reviewer requests disclosure, correction, deletion, or any other action, the user is responsible for responding and must appropriately use the revocation and deletion features provided by the Service.

Article 5 (Prohibited conduct)

Users must not engage in any of the following when using the Service.

  • Conduct that violates laws or public order and morals
  • Conduct connected with criminal activity
  • Conduct that infringes the intellectual-property, portrait, privacy, reputation, or other rights or interests of us, other users, or third parties
  • Conduct that places an excessive burden on the Service’s network or systems, or unauthorized access
  • Conduct that may interfere with operation of the Service
  • Any other conduct we determine to be inappropriate

Article 6 (Limitation of liability)

We make no express or implied warranty that the Service is free from factual or legal defects, including defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, or infringement of rights. Except in cases of our intentional misconduct or gross negligence, we are not liable for any damage arising from the Service. Even where we are liable, our liability is limited to the fees you paid to us in the month immediately preceding the month in which the damage occurred.

Article 7 (Changes to these Terms)

We may change these Terms when we consider it necessary. Updated Terms take effect when displayed in the Service. Continued use of the Service after the update constitutes acceptance of the updated Terms.

Article 8 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. The Kagoshima District Court, which has jurisdiction over our location, has exclusive agreed jurisdiction as the court of first instance for disputes relating to the Service.
